I. Introductory Provisions

  1. These Terms and Conditions and the Complaints Procedure (hereinafter referred to as "Terms and conditions for purchase") govern the rights and obligations the company Kulturní centrum Falcon z. s. , ID No.: 07516819, VAT No.: CZ07516819, with with its registered office at Lindnerova 1610/4, Libeň (Prague 8), 180 00 Prague, registered in the Commercial Register Register maintained by the Municipal Court in Prague, Section L, Insert 70954 (hereinafter referred to as "Cultural Centre Falcon z. s. s. ") and third parties when selling tickets to any cultural, sporting and/or other events organized by the Organizer (hereinafter referred to as "Events") through the Cultural Centre Falcon z. s. .
  2. The organizer of the Event is a natural or legal person person other than Kulturní centrum Falcon z. s. , which arranges and organizes the Event and which is the seller of tickets for the Event (hereinafter referred to as "Organiser"). Identification of the Promoter and its contact details are always given for the specific Event.
  3. These Terms and Conditions of Purchase consist of form an integral part of the contract concluded between the Promoter as the Seller and the purchaser of tickets to the Event through Kulturní centrum Falcon z. s. and the purchaser, by purchasing the tickets at the same time confirms that he/she has read these Terms and Conditions for Purchase.
  4. Cultural Centre Falcon z. s. s. sells tickets through website www.falconclub.cz, or internet websites that on www.falconclub.cz they're rerouting, and further, through their points of sale or points of sale contractual partners of Kulturní centrum Falcon z. s. , including brick-and-mortar stores, websites and/or other applications of the Organisers or other contractual partners of Kulturní centrum Falcon z. s. (hereinafter referred to as "Sales network").
  5. For the purchase of tickets through Sales Network is also considered to be a bulk order directly from the Cultural Centre Falcon z. s. , through its sales or other department.
  6. Contact the Cultural Centre Falcon z. s. means to contact the authorized person to their specific phone number or email, if known, or to a general phone number or e-mail listed in the Contact.

II. Subject of the contract

  1. The subject of the contract is the obligation of the Cultural Centre Falcon z. s. to deliver on behalf of and on behalf of the Organiser's account to the Purchaser for tickets to the Event chosen by the Purchaser, in the quantity of requested by the Buyer, limited by the availability of tickets submitted for sale by the Cultural Centre Falcon z. s. by the Organiser and the Purchaser's obligation to pay the ticket price.
  2. The contract is concluded by payment of the entrance fee by the buyer.
  3. Cultural Centre Falcon z. s. undertakes to deliver tickets to the buyer without the purchaser without undue delay after payment of the entrance fee, with the proviso that in the case of purchase of tickets via the Internet, they will be delivered electronically to the e-mail address provided by the purchaser and in in the case of tickets purchased by other means in the Sales Network (at the box office at Kulturní centrum Falcon z. s. , or at the business partner Kulturní centrum Falcon z. s. ), the tickets will be delivered to the buyer immediately after the payment of the entrance fee by the relevant employee from whom the buyer purchases the tickets. The buyer is not entitled to delivery of the tickets before the full amount of the ticket price has been paid.
  4. Delivery of tickets to the purchaser by the Cultural Centre Falcon z. s. are all obligations of Kulturní centrum Falcon z. s. arising from the contract are fulfilled.

III. Rights and obligations of the parties in relation to the event for which the tickets are purchased

  1. The Buyer acknowledges that the Cultural Centre Falcon z. s. is not the Organizer of the individual Events for which tickets are sold. Cultural Centre Falcon z. s. is responsible for the production, sale and distribution of tickets to purchasers for individual Events always on behalf of and for the account of their Organiser, on the basis of a contractual relationship between Kulturní centrum Falcon z. s. and the Event Organiser. By purchasing a ticket for Event creates a legal relationship between the purchaser and the Organiser of the Event. Cultural Centre Falcon z. s. does not therefore bear any responsibility for the performance of the Event Organizer's obligations arising from the contractual relationship between the purchaser and the Event Organiser.
  2. The Falcon Cultural Centre z. s. is in no way responsible for the conduct of any Event or for the fact that it does not take place, nor is it responsible for any change to the Event or the dates or location of any Event, or for any change in the course of any Event, or for any any events occurring at the Events or for any facts whatsoever, which may arise from the holding or non-holding of the Event. Falcon Cultural Centre z.s. shall not be liable for any obligations of the Event Organiser. Furthermore, the Cultural Centre Falcon z.s. shall not be liable for any property or non-pecuniary damage caused to the purchaser or any other person by the Event Organiser, or incurred by the Purchaser or any third party in connection with the Event. Any claims by the Buyer or any third party must always be made to the Promoter Event.
  3. By purchasing a ticket, the buyer undertakes to to abide by the rules set by the Event Organizer. Furthermore, by purchasing the ticket the buyer agrees to by purchasing a ticket, the Purchaser agrees to abide by the operating and visitor regulations of the Event venue.
  4. The Organiser of each Event reserves the right to to change its program, date and venue. By purchasing a ticket, you agree to the customer acknowledges this right of the Organiser.
  5. For the validity and authenticity of tickets The Cultural Centre Falcon z. s. is not responsible for the validity of tickets purchased outside the Sales Network.

IV. Ticket purchase procedure and payment conditions

  1. The price for each ticket is listed at each Event individually. Any incidental charges are also listed for each Event or costs associated with the purchase of the ticket.
  2. In case of ticket purchase via the website www.falconclub.cz is the payment for the ticket can only be paid by credit card or bank transfer.
  3. Tickets are not sent by post, namely not even by cash on delivery.

V. Withdrawal from the contract

In accordance with the provisions of Section 1837(j) of Act no. 89/2012 Coll., Civil Code, as amended, the buyer has no right to from the contract concluded between the Purchaser and the Promoter through the Cultural Centre Falcon z. s. to withdraw under Section 1829 of the Civil Code (withdrawal from the contract within 14 days without reasons), given that this is a contract for the use of free and the performance is by the entrepreneur, i.e. in this case the Event Organizer, the Event Organizer, is to be provided within the specified period.

VI. Complaints Procedure

  1. All claims for tickets purchased at Kulturní centrum Falcon z. s. through the Sales Network are subject to the following Terms and Conditions of Purchase and the Complaints Policy set out in this Article VI.
  2. The buyer is entitled to a refund of the entrance fee for the ticket only in the cases and under the conditions set out below.
  3. The buyer is not entitled to exchange the ticket. In the event of damage, destruction, loss, theft or other deterioration of the ticket the ticket will not be replaced with a new ticket and the purchaser will not be compensated or refund the price paid for the ticket.
  4. The Cultural Centre Falcon z. s. assumes no responsibility for the fact that it will not delivery of the ticket to the buyer due to reasons on the buyer's side, in particular because the ticket cannot be delivered to the buyer at the buyer's place of purchase. the e-mail address provided (e.g. overflowing mailbox, spam filter, etc.).
  5. If the buyer has not received the ticket within 1 hour after the payment of the admission fee, he/she is obliged to immediately, but no later than 24 hours from the date of expiry of the aforementioned delivery period the deadline of 24 hours after the deadline of 24 hours, contact the Cultural Centre Falcon z. s. and notify that he/she has not received the paid ticket. For this purpose, the purchaser is obliged to inform the Falcon Cultural Centre z.s. of the name, surname and e-mail address he/she has provided as contact or identification details when purchasing the ticket. In the event that the Cultural Centre Falcon z. s. finds out that the ticket was not actually delivered to the purchaser, and this is not the case referred to in 4 of this Complaints Procedure, and the purchaser has notified the Kulturní Centre Falcon z. s. , that the ticket has not been delivered to the purchaser within the above mentioned period and in the manner specified above, the following procedure will be followed:
    1. The Cultural Centre Falcon z.s. undertakes to deliver the following within 24 hours at the latest but 1 hour before the Event, to send the buyer a new ticket to the buyer the e-mail address provided,
    1. if the Event has already taken place, the Cultural Centre Falcon z. s. undertakes to refund the buyer the admission fee paid, and no later than 30 days from the date of the claim by the buyer.
  6. In the event that the Promoter fails to the venue or date of the Event is changed or the Event is cancelled, the the buyer, who has provided the Cultural Centre Falcon z. s. with his contact details (e-mail, telephone, postal address, fax, etc.) will be informed of this fact by any of the The Falconer will be notified through any of these contacts.   7. If the Promoter changes the date of the Event, the purchaser has the right to a refund of the entry fee. This right may be exercised by the buyer to be exercised no later than the fifth working day following the original date of the Event and only if the ticket has not yet been used. If the buyer does not exercise the his right within the aforementioned period, he shall be deemed to be interested in attending the Event in the changed date.
  8. In the event that the Promoter fails to fully cancellation of the Event, the purchaser shall be entitled to a refund of the entry fee. In case of purchase tickets at the Kulturní centrum Falcon z. s. outlet or at the outlet of the contractual partner Kulturní centrum Falcon z. s., the purchaser must exercise this right without undue delay, no later than on the fifth working day following the date of the Event. In other cases, the Buyer's right under of this paragraph shall be deemed to have been exercised automatically.
  9. The Falcon Cultural Centre z. s. will refund admission fees as described below and only up to the amount of funds provided by the Cultural Centre Falcon z. s. Organizer. These funds means in particular the funds that the Cultural Centre Falcon z. s. received from the purchasers for the sale tickets and which have not yet been transferred to the Event Organiser. In the part in which the purchaser's claims are not satisfied, the Organiser shall be solely liable to the purchaser of the cancelled Event and not the Cultural Centre Falcon z. s. .
  10. If the conditions for the refund of the entrance fee according to paragraphs 7 to 9 of this Complaints Procedure, the entrance fee will be will be refunded to the purchaser as follows:
    1. in case of electronic ticket purchase via the website www.falconclub.cz the entrance fee will be refunded via the credit card used to pay the admission fee, and in in the case of payment by bank transfer to the bank account from which the admission fee was paid sent,
    1. in case of ticket purchase in the sales Kulturní centrum Falcon z. s. or at a sales outlet of the contractual partner Kulturní centrum Falcon z. s., the ticket price will be refunded in the manner chosen by the customer the purchaser (cash or non-cash), provided that the condition for the refund of the ticket price is is that the buyer agrees to return the admission without undue delay (within 7 days of the date of the original date of the cancelled Event) to the point of sale at which he/she purchased the tickets for the Event and returns the purchased tickets,

  12. At Kulturní centrum Falcon z. s. you cannot claim a ticket for any Event that the customer has not purchased from the Sales Network.

VII. Out-of-court dispute resolution

In the event that there is a dispute between the Event Organiser and a customer who is a consumer, a consumer dispute arises in in connection with the purchase of a ticket to an Event organised by the Organiser or in connection with in connection with the holding or running of the Event, which cannot be resolved by mutual agreement between that customer and the Promoter, the customer may submit a claim to the out-of-court resolution of such dispute to a designated out-of-court resolution entity consumer disputes, which is the Czech Trade Inspection Authority, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, web: http://adr.coi.cz. The customer can also use the online dispute resolution platform set up by the by the European Commission at http://ec.europa.eu/consumers/odr/.

VIII. Protection of personal data during purchase

  1. The Falcon Cultural Centre z. s. processes personal data during ticket sales. data provided by the purchaser when purchasing a ticket, in accordance with in accordance with Privacy Policy.
  2. In case of incorrectly entered data (e.g. a typo in a name or phone number), the buyer is obliged to contact Kulturní Centre Falcon z. s. .

IX. Final Provisions

  1. Should any of the provisions of the of these Terms and Conditions of Purchase is invalid or ineffective, this shall not affect the validity and effectiveness of the other provisions of these Terms and Conditions of Purchase, which are severable from the invalid or ineffective provision.
  2. Cultural Centre Falcon z. s. is entitled to change these Terms and Conditions at any time. terms and conditions of purchase.
  3. All provisions of these Terms and Conditions Terms and Conditions of Purchase and the contractual relationship between the Promoter, the Purchaser and the Cultural Centre Falcon z. s. shall be governed by the Czech law.
  4. Any disputes arising from the purchase tickets through Kulturní centrum Falcon z. s. will be settled in the general courts of the Czech Republic, unless settled out of court.
